Kieth Haring, Basquiat, Bansky, to name just a few have shown graffiti is a valid form of speech and expression. While property damage needs to be addressed, monetary penalties are a civil penalties issue. Criminal penalaties for graffiti are wrong and selectively enforced.

Most states still enforce criminal penalties for graffiti. Criminal penalties infringe on the speech protections of the actor under the First Amendment.
